1. Purpose
These Terms and Conditions govern access to and use of the Bryana service, a SaaS management platform for tattoo studios accessible at app.bryana.es.
2. Acceptance
By registering and subscribing to any plan, the user expressly accepts these Terms. If you do not agree, you must refrain from using the service.
3. Description of the service
Bryana provides lead capture tools, message automation via Instagram, scheduling, client management, billing and reporting aimed at tattoo studios. Available features depend on the subscribed plan.
4. Registration and account
The user must provide accurate information and keep it up to date. They are responsible for the confidentiality of their credentials and for all activity carried out from their account.
5. Plans, pricing and billing
Current plans and prices are published on bryana.es and at app.bryana.es/precios. When subscribing to a plan, payment is charged when access to the service is activated. The subscription renews automatically at the end of each period (monthly or annual) unless cancelled beforehand. Payments are processed through Stripe. Prices include VAT where applicable under current regulations.
5 bis. 15-day refund guarantee policy
On a voluntary basis, Bryana offers a refund guarantee limited to the first charge of any plan: if the user requests a refund within 15 calendar days of plan activation, the full amount of that charge will be refunded, under the terms published on the Refund guarantee page. This policy forms an integral part of these Terms as to its scope and procedure, without prejudice to the rights available to the user as a consumer under applicable law.
6. Cancellation and refunds
Except as expressly provided in the 15-day refund guarantee for the first charge (section 5 bis and linked page), the user may cancel their subscription at any time from the Stripe customer portal accessible in their profile. Cancellation prevents renewal in the next billing cycle but does not by itself entitle the user to a refund of the current already-billed period. No partial refunds are made for unused months except as provided in the aforementioned first-charge guarantee. In the event of a serious service failure attributable to Bryana, each case will be assessed individually.
7. User obligations
The user agrees to use the service lawfully, not to send unsolicited bulk messages (spam) through the platform, not to use Bryana for unlawful activities, and to comply with the terms of integrated platforms (Instagram, Stripe, etc.). Breach may result in immediate suspension of the service without entitlement to a refund.
8. Intellectual property
All rights in Bryana's software, brand, design and content are the exclusive property of the provider. The user receives a limited, personal, non-transferable and revocable licence to use the service for the duration of their subscription.
9. Limitation of liability
Bryana is provided "as is" and "as available". We do not guarantee uninterrupted availability or complete absence of errors. The provider's maximum liability to the user is limited to the amount paid by the user in the 3 months preceding the event giving rise to the claim.
10. Changes to the Terms
Bryana may modify these Terms by giving at least 15 days' notice by email or notice in the panel. If the user does not agree with the changes, they may cancel their subscription before they take effect.
11. Governing law and jurisdiction
These Terms are governed by Spanish law. The provider is Iker Jurado (Tax ID: 47594277K), with registered address at Carrer Ignasi Mas, s/n, Barcelona. For any dispute, the parties submit to the Courts of Barcelona, unless consumer law establishes a different forum in favour of the consumer user.
